Legal Challenge

Petition by BC Government and Service Employees' Union (BCGEU)

In February, 2004, the BC Government and Service Employees' Union (BCGEU) launched a legal challenge in the province's Supreme Court against the Ministry of Health Services and the Medical Services Commission claiming ultra vires actions — that these groups had, in fact, exceeded the scope of their authority by outsourcing public sector management of medical records to a privately owned company.

On March 23, 2005 the BC Supreme Court rejected BCGEU's petition to prevent the government's intended privatization of the provincial Medical Services Plan (MSP); however, on April 20, 2005, BCGEU announced its decision to appeal the decision.
